The U.S. Environmental Protection Agency’s Clean Water Act Hazardous Substances Facility Response Planning (FRP) rule is officially in effect as of May 28, 2024! 🌊🛑

While you have a three-year grace period to comply, understanding how this rule impacts your facility or corporation can be complex, especially with its ties to navigable waters of the State/US.

Previously, only facilities storing certain amounts of oil near sensitive environments needed FRPs and Spill Prevention Control and Countermeasure plans. But now, the new CWA FRP Rule expands these requirements to include facilities handling hazardous substances above certain thresholds.

If your facility is affected, you must prepare for worst-case discharge scenarios involving CWA-listed hazardous substances.
